TERMS AND CONDITIONS

Company: 1754 Works LLC d/b/a Join, or Die! Tours (“Join, or Die! Tours,” “we,” “us,” or “our”)

These Terms and Conditions (“Terms”) govern all ticket sales and participation in walking tours operated by Join, or Die! Tours. By purchasing a ticket or participating in any tour, you agree to these Terms.

1. Services
Join, or Die! Tours offers professionally guided walking tours of historic Philadelphia neighborhoods. Public tours typically last 75–90 minutes, covering approximately 1.25 miles under easy walking conditions. Private tours may vary in duration or route based on prior arrangement.

2. Ticketing and Payment
• Tickets are sold exclusively online through joinordietour.com, powered by Peek Pro as our booking platform and Stripe as our payment processor.
• Tickets may also be purchased through verified third-party resellers including TripAdvisor, Viator, GetYourGuide, and Airbnb Experiences.
• All prices are listed in U.S. dollars and include applicable local taxes. Prices are subject to change without notice.
• You must present a valid electronic or printed ticket confirmation at check-in. Tickets are valid only for the specific date and time purchased.

3. Refunds and Cancellations
• Public Tours: Guests may cancel up to 24 hours before the tour start time for a full refund.
• Private Tours: Cancellations must be made at least 48 hours in advance for a full refund.
• No refunds will be issued for no-shows, late arrivals, or missed tours.
• Refunds are processed through the original method of payment.
• In the event of extreme weather or unforeseen circumstances (e.g., unsafe walking conditions), Join, or Die! Tours reserves the right to cancel or reschedule tours. Guests will receive a full refund or the option to reschedule.

4. Weather and Route Changes
All tours operate rain or shine, except in cases of severe weather or public safety concerns as determined by Join, or Die! Tours.
We reserve the right to alter routes, schedules, or tour length due to road closures, construction, events, or other factors beyond our control.

5. Accessibility and Participation
Join, or Die! Tours aims to make experiences accessible to all guests. Routes are generally flat and considered easy walking, but some historic sidewalks and cobblestone areas may limit ADA accessibility.
Guests should wear comfortable shoes and be physically able to walk for up to 1.25 miles. Children under 16 must be accompanied by an adult. Pets are not permitted unless specified as service animals.

6. Alcohol Policy
At this time, no alcohol is permitted on public tours. Private tours involving alcohol (BYOB or otherwise) may be permitted only with prior written approval from Join, or Die! Tours and in compliance with applicable city and state laws.

7. Safety and Conduct
Join, or Die! Tours reserves the right to remove any guest who:
• Appears intoxicated or disruptive
• Engages in behavior that endangers themselves or others
• Fails to comply with staff instructions

No refunds will be issued for removal due to misconduct. Guests participate at their own risk and agree to follow all local laws and safety guidelines during the tour.

8. Liability and Assumption of Risk
Participation in walking tours involves inherent risks, including uneven surfaces, street crossings, and environmental conditions.
By attending, you voluntarily assume all risks and agree that 1754 Works LLC, its employees, agents, and contractors shall not be liable for any loss, injury, damage, or delay except in cases of proven gross negligence.
We recommend maintaining personal health insurance coverage during participation.

9. Photography and Media Use
By participating in a tour, you grant Join, or Die! Tours the right to photograph, film, or record your image, likeness, or voice for marketing and promotional purposes in any medium.
We will make reasonable efforts not to feature individuals prominently without consent upon request. Guests who prefer not to be photographed may inform their guide prior to the tour.

10. Intellectual Property
All content, including text, photos, videos, logos, and tour narratives, is the property of 1754 Works LLC and may not be copied, distributed, or used for commercial purposes without written permission.

11. Privacy
Your personal information is collected and processed through our booking provider, Peek Pro, and payment processor, Stripe, in accordance with their privacy policies. Join, or Die! Tours does not store or sell customer payment information.

12. Third-Party Bookings
If you purchase your ticket through a third-party platform (TripAdvisor, Viator, GetYourGuide, Airbnb Experiences), that platform’s terms and refund policies may also apply. Any disputes related to those bookings must be directed to the original platform.

13. Force Majeure
Join, or Die! Tours shall not be held liable for failure to perform any obligation under these Terms if prevented by events beyond our reasonable control, including but not limited to weather events, public emergencies, strikes, or government restrictions.

14. Governing Law
These Terms are governed by and construed under the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Philadelphia County, Pennsylvania.

15. Changes to Terms
Join, or Die! Tours reserves the right to update or modify these Terms at any time without prior notice. The most current version will always be available at joinordietour.com/terms. Continued participation in our tours constitutes acceptance of any revised Terms.
